Terms of service

These terms apply when you create a Kickstart developer account or register an app with a Kickstart service operated by Hudson Heavy Industries Ltd. Rules specific to Kickstart Signal apply only when you use Kickstart Signal. Where you and Hudson Heavy Industries Ltd agree separate written terms for a specific feature, those terms prevail over these for that feature.

The service

Kickstart Signal is a free service for independent developers to collect feature requests, votes, and comments from the people using their apps, operated by Hudson Heavy Industries Ltd. Kickstart Signal may be unavailable or return no content. Hudson Heavy Industries Ltd does not promise any particular result.

Your apps

You may register only an app that you own or are authorized to represent. Each app can be registered with only one account at a time, and each App Store developer’s apps can be linked to only one account.

To use Kickstart Signal, your app must be on the App Store, you must verify control through the app’s listed website or App Store promotional text, and the app must be approved. The app and its listing must remain live, accurate, lawful, and suitable for their audience. If your authority ends, you must delete the app from the Kickstart services where it is registered.

Your board

Everything shown to the people using your app is content you chose to publish. Submissions are private until you approve them, and you may edit, reject, merge, unpublish, or delete them at any time. You are the publisher of your board, and you are responsible for what appears on it, including for keeping it lawful and suitable for your app’s audience and for responding to anyone who asks you to change or remove something they submitted.

You must not publish content that is unlawful, infringes someone else’s rights, or is abusive, misleading, or harmful. You must not use Kickstart Signal to collect names, contact details, or other information about the people using your app, and you must not attempt to identify them through it.

Public promotion

You grant Hudson Heavy Industries Ltd a non-exclusive, worldwide, royalty-free license to use your app’s name, icon, and public App Store listing materials to promote your app and the Kickstart services it uses, including on our websites, social media, and marketing materials, while your app participates in those services. We may publicly identify your app as using those services and include it in aggregate counts of participating apps. This permission does not transfer ownership of your materials or authorize us to imply an endorsement beyond your app’s participation.

Fair participation

Do not manipulate votes, submissions, accounts, or apps, or otherwise act in ways that harm Kickstart Signal or its members.

To use the official Kickstart Signal service, you must use an unmodified release of KickstartSDK published by Hudson Heavy Industries Ltd. You may configure the SDK through its documented public API. You may modify the SDK under the MIT License, but modified versions may not connect to the official Kickstart Signal service. Hudson Heavy Industries Ltd may block modified SDKs and reject, suspend, or remove any app or developer account that uses one with the service.

You remain responsible for your app, including its App Review compliance, accessibility, privacy disclosures, and consent requirements.

Hudson Heavy Industries Ltd may reject, suspend, or reactivate an app, and may suspend or reactivate a developer account, when reasonably needed to operate Kickstart Signal, comply with law, enforce these terms, or protect the service, its members, or their users. This includes conduct these terms do not specifically describe. Suspension applies across every Kickstart service the app or account uses.

Changes to these terms

Hudson Heavy Industries Ltd may update these terms to reflect changes in law, the Kickstart services we provide, or how those services operate. We will email you at least 30 days before any material changes take effect. The notice will explain the changes, link to the updated terms, state their effective date, and explain how continued use signifies acceptance.

By continuing to use the affected services on or after the effective date stated in that notice, you agree to the updated terms. If you do not agree, you must stop using the affected services before that date. You may delete your apps or your account at any time.

Ending participation

You may disable a board, delete all of your Signal data, delete your apps, or delete your account at any time. Hudson Heavy Industries Ltd may suspend or end participation for a breach of these terms, loss of authority, legal or security concerns, or closure of the service.

Kickstart Signal is provided free of charge and as available. To the extent permitted by law, Hudson Heavy Industries Ltd is not responsible for lost revenue, lost business, or other indirect loss caused by use or unavailability of the service. Nothing in these terms excludes liability that cannot lawfully be excluded.
